Scope and Provider Details

This document sets out how PhiWebs subscription services purchased through phiwebs.com are delivered, how the right of withdrawal is exercised, and how refunds are made. It applies together with the Distance Sales Agreement and the Pre-Information Form; in the event of a conflict, the Distance Sales Agreement prevails.

Delivery — Opening Access to the Service

PhiWebs is a digital service. What is sold is the subscription plan selected at checkout, not a physical good, so there is no shipment, courier or delivery to an address.

The place of delivery is the customer’s PhiWebs account. Access opens immediately after the payment is approved by the payment institution and becomes available in the account. Confirmation is sent to the customer by order summary and email.

If payment is approved but access does not open for a technical reason, the customer should write to sales@phiwebs.com and the provider will open access without delay. If access is not opened within 30 days of the order for a reason attributable to the provider, the customer may terminate the contract and any amount collected is refunded.

Delivery Charges

There is no physical delivery, so no shipping, freight or delivery charge applies. No amount is requested from the customer beyond the tax-inclusive total displayed at checkout.

Right of Withdrawal and its Statutory Exception

Under the Turkish Distance Contracts Regulation, the customer may withdraw from the contract within 14 days of it being concluded, without giving any reason and without penalty. Notice of withdrawal must be given clearly within that period to sales@phiwebs.com or through the cancellation channel in the account screen.

Under Article 15 of the Regulation, the right of withdrawal does not apply to services whose performance has begun, with the customer’s consent, before the withdrawal period expires, nor to intangible goods supplied instantaneously in electronic form. This exception applies where you ask for access to be opened immediately after ordering; your consent to this is taken separately at checkout.

Returns and Refunds

Where a valid notice of withdrawal reaches the provider, the full amount collected is refunded within 14 days. The refund is made in a single transaction to the payment instrument used for the purchase, at no cost to the customer.

The refund is passed to the payment institution the same day. How long it then takes to appear on the customer’s card statement depends on the issuing bank and is typically 2–10 business days; that period is outside the provider’s control.

Where the right of withdrawal is not exercised: a subscription may be cancelled at any time, cancellation takes effect at the end of the current billing period, and access continues until then. Without prejudice to statutory withdrawal and refund rights, amounts collected for completed periods are not refunded and no partial-period refund is made.

Refund requests arising from defective performance, from access not opening for reasons attributable to the provider, or from a duplicate charge are not subject to the 14-day withdrawal period; write to sales@phiwebs.com and the refund will be made according to the outcome of the review.

For disputes arising from the contract you may apply, within the monetary limits announced annually by the Turkish Ministry of Trade, to the Consumer Arbitration Committee or the Consumer Court at your place of residence or at the place where the transaction was made.
